• Send or draft follow-up emails automatically
• Manage email templates and signatures
• Track email delivery and responses

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by authenticating with your Google account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

• Provide accurate and complete information
• Maintain and update your account information
• Notify us immediately of any unauthorized use
• Use the Service only for lawful purposes

4. Gmail Access and Permissions

By using the Service, you grant Promptly permission to:

• Access your Gmail account to create drafts and send emails
• Read thread information to maintain conversation context
• Store necessary OAuth tokens for service functionality

You can revoke these permissions at any time through your Google account settings. Revoking access will prevent the Service from functioning.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited, or harassing emails
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Impersonate others or misrepresent your identity
• Interfere with or disrupt the Service

6. Subscription and Payment

6.2 Billing

• Paid plans are billed monthly or annually as selected
• Payments are processed securely through Stripe
• All fees are non-refundable unless required by law
• We reserve the right to change pricing with 30 days notice

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Promptly and protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all content you create using the Service, including email templates and sequences. By using the Service, you grant us a license to use, store, and process your content solely to provide the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or failures
• Third-party service outages (e.g., Gmail API)
• Force majeure events

9. Limitation of Liability

To the maximum extent permitted by law, Promptly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or information
• Business interruption
• Email delivery failures

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Promptly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or transmit through the Service

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. We may delete your account and data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
